Like France, the United States did not recognize Haiti’s independence until 1862, precisely because white Americans worried that Haiti’s existence challenged their slave-driven economy. There were several emigration movements led by leaders such as Martin Delany and James Theodore Holly, who encouraged African-Americans to settle in Haiti.

It defined Haitians in Article 44 as all Africans, indigenous people, and their children born in the colonies or abroad who resided in Haiti. Article 39 prohibited any white person, except those who served in the military or performed civil service, or was admitted to the territory prior to 27 December 1806 from being Haitians.
